What happens to my clients if I leave my brokerage?

SHORT ANSWER

Clients choose their broker, but files, renewals and data are governed by your brokerage agreement and provincial rules, so read both before you move and plan live files first.

In practice most clients follow the broker they trust. In law, it is more careful than that. A client is free to work with whoever they choose, but the file for a mortgage that funded belongs to the brokerage of record, the renewal notice may be sent by the lender to the brokerage on file, and your agreement may say something about client data and solicitation after you leave.

So the honest sequence is: read your agreement, map every live file and agree where each closes, tell clients you are moving once you are permitted to, and rebuild your renewal list from the records you are entitled to keep. Clients you originate after the move are yours under the new agreement, and at A.I.M.I. Collective that includes the renewal and the referral.

Bankers face a stricter version of this question. Brokers should read their agreement; bankers should read the relationships guide before anything else.

Our approach

A switch here is planned around your pipeline, not ours. We map every live file with you, run the licence transfer and lender registrations in parallel, and line up the first hard file for the Deal Desk so the first week is a funded file, not a form. Clients you originate are yours, including the renewal and the referral, and that is written down.
