Can I contact my bank clients after I become a mortgage broker?

SHORT ANSWER

Usually not for the period set by your non solicit clause, and never using bank records. Clients who find you and reach out on their own are a different matter.

You built the relationships, but the bank owns the records. Most bank employment agreements include a non solicit clause that stops you approaching bank clients for a set period after you leave. Using bank data, from a client list to contact details kept from work, is off limits whatever the clause says.

Clients who find you on their own and reach out are treated differently, and new clients you originate as a broker are yours from the first file.

Read your agreement with a lawyer before you contact anyone. This is general information rather than legal advice.

Our approach

The conversation is confidential and nothing is said to your employer. Clients you originate as a broker are yours, including the renewal and the referral. The client list you built at the bank stays at the bank, and we will not ask you for it. What we carry is the licensing paperwork, the lender registrations and the first hard files while you learn where they go.
